Terms of Service — Blackwall VPN

Product: Blackwall VPN (mobile apps for iOS and Android, and API at https://vpn.artevus.com)

Operator: Artevus Technologies (Private) Limited ("Artevus", "Company", "we", "us", "our")


1. Introduction and Acceptance of Terms

These Terms of Service ("Terms", "Agreement") constitute a legally binding agreement between you ("User", "you", "your") and Artevus Technologies (Private) Limited regarding your use of Blackwall VPN — our consumer VPN service delivered through mobile applications and the backend API at https://vpn.artevus.com (collectively, the "Service").

By accessing or using the Service, you confirm that:

  • You have read, understood, and agree to be bound by these Terms and our Privacy Policy.
  • You are at least 13 years of age (or the minimum age required by your jurisdiction; 16 in the EU where applicable).
  • If you are using the Service on behalf of an organization, you have authority to bind that organization to these Terms.
  • Your continued use of the Service constitutes acceptance of any updates to these Terms.

If you do not agree to these Terms, discontinue use of the Service immediately.

General terms for other Artevus products are described separately at artevus.com/terms. Where this document and the general Artevus terms conflict for Blackwall VPN, these Terms control.


2. About Blackwall VPN

Blackwall VPN is a no-log consumer VPN product operated by Artevus. The Service provides encrypted connectivity through Artevus-operated WireGuard servers. Traffic is routed in full-tunnel mode (IPv4 and IPv6) through the server region you select.

Exit nodes are currently located in the United States and India. Server availability, capacity, and regions may change over time.

The Service includes:

  • Account registration and authentication (email/password and optional Google or Apple sign-in)
  • Per-user WireGuard VPN device provisioning
  • Free-tier and paid-tier plans
  • Push notifications for service events
  • Support and feedback channels

3. User Accounts

3.1 Account Registration

To use the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information (including email, full name, country, device identifier, platform, and device name as required).
  • Verify your email address before accessing protected features.
  • Maintain the accuracy of your account information.
  • Keep your login credentials confidential and secure.
  • Notify us promptly of any unauthorized access to your account.
  • Accept responsibility for all activity under your account.

3.2 Account Eligibility

You must be at least 13 years of age (or 16 in the EU where required). By creating an account, you represent that you meet all applicable eligibility requirements and that use of a VPN is lawful in your jurisdiction.

3.3 Account Security

You are solely responsible for maintaining the confidentiality of your credentials and for all activities under your account. Artevus is not liable for loss or damage arising from your failure to secure your account.

3.4 Single-Device Session Policy

Blackwall VPN enforces one active app login per account. If you sign in on a different device, the previous session may be revoked, and you may receive a push notification and/or email that your session was replaced.

3.5 Account Deletion and Recovery

You may delete your account through the app (Settings → Delete Account) or by contacting us. In-app deletion performs a soft delete: VPN access and sessions end immediately, but the account may be recoverable via email verification for an indefinite period. Permanent erasure is available on request as described in our Privacy Policy. Soft delete is not the same as irreversible hard delete.


4. The VPN Service

4.1 How the Service Works

When you connect, your device traffic is encrypted and routed through a WireGuard tunnel to the selected Artevus server. Your public IP while connected is the exit node's IP address for that region.

Client configurations are issued by the Service. You must use the configuration provided for your account and device. Sharing configurations or credentials with others is prohibited.

4.2 One Active VPN Device

Each account may have one active VPN device at a time. Provisioning or reconnecting a device may disconnect any previously active VPN peer. You may receive a notification when your VPN is disconnected because another device claimed the connection.

4.3 Full Tunnel

The Service defaults to full-tunnel routing (0.0.0.0/0 and ::/0). All IPv4 and IPv6 traffic from your device is intended to go through the VPN while connected. Split tunneling is not currently offered as a user-facing feature.

4.4 DNS

VPN client configurations currently set DNS to Cloudflare public DNS (1.1.1.1). DNS handling by third parties is governed by their own policies. See our Privacy Policy.

4.5 Service Limitations and Exit IP Reputation

Exit nodes use datacenter IP addresses. Some websites, services, or networks may block, challenge, or treat datacenter IPs differently from residential connections. That behavior is outside our control and does not, by itself, constitute a defect in the Service.

We do not guarantee uninterrupted connectivity, specific speeds, or access to any particular website or service.

4.6 Forced App Updates

We may require a minimum app version. If your app is below the minimum, the Service may refuse to continue until you update. This is for security and compatibility.


5. Plans, Quotas, and Subscriptions

5.1 Free Tier

Free-tier accounts are subject to data caps, currently:

  • 10 GiB per UTC calendar month
  • 500 MiB per UTC calendar day

When a free-tier quota is exceeded, we may disconnect active VPN peers and block new device provisioning until the next UTC day and/or month, or until you upgrade to a paid plan. Limits may change; current limits are shown in the app via account status.

5.2 Invite Rewards

Eligible free-tier users may receive additional monthly quota (currently +1 GiB on the current UTC month only) for successful invite activations, up to a maximum of 3 successful invites per inviter. Invite rewards do not carry forward to future months and do not change the daily cap. Abuse of the invite system may result in revocation of rewards or account suspension.

5.3 Paid Tier (Premium)

Paid subscriptions are offered through the Apple App Store and Google Play Store and managed via RevenueCat (entitlement such as blackwall_premium). Paid users are not subject to the free-tier bandwidth caps while their subscription is active.

5.4 Billing and Renewals

  • Subscriptions are billed by Apple or Google according to the store's terms.
  • Subscriptions typically renew automatically unless cancelled through the store before the renewal date.
  • Manage or cancel subscriptions in your Apple ID or Google Play account settings — not through Artevus billing portals.

5.5 Refunds

Refunds for in-app purchases are handled by Apple or Google under their respective refund policies. Contact the store from which you purchased. Artevus does not process card payments directly and generally cannot issue store refunds on your behalf.


6. Permitted Use and Restrictions

6.1 Permitted Use

Subject to these Terms, Artevus grants you a limited, non-exclusive, non-transferable, revocable license to access and use Blackwall VPN for lawful personal use.

6.2 Acceptable Use — VPN-Specific

You agree not to use the Service to:

  • Violate any applicable law or regulation in your jurisdiction or in the jurisdiction of the exit server.
  • Engage in copyright infringement, fraud, phishing, hacking, unauthorized access, or distribution of malware.
  • Conduct port scanning, denial-of-service attacks, or other network abuse.
  • Send spam or operate open mail relays.
  • Harass, threaten, or harm others.
  • Resell, share, or commercially redistribute the Service or your account credentials.
  • Circumvent quotas, single-device limits, billing, or technical controls.
  • Attempt to probe, scan, or reverse engineer our infrastructure beyond normal use of the app.

You are solely responsible for your activity while connected to the VPN. Your use must comply with local law; we do not encourage illegal use of the Service.

6.3 BitTorrent and P2P Egress Policy

To protect our exit IP reputation and infrastructure, our servers apply an egress policy that blocks well-known BitTorrent ports and certain tracker/indexer IP ranges. This is a deterrent (not deep packet inspection) and may not block all P2P traffic.

You should not use the Service for BitTorrent or similar P2P file-sharing. We may expand or adjust egress policy at any time. Abuse related to P2P or other high-risk traffic may result in suspension or termination.

6.4 Other Prohibited Activities

You also agree not to:

  • Copy, modify, reverse engineer, or create derivative works of the Service except as permitted by law.
  • Introduce malware or interfere with the integrity or performance of the Service.
  • Scrape or harvest data from the Service without written permission.
  • Impersonate any person or entity.
  • Use the Service in any way that could overload or impair our systems.

7. Intellectual Property

7.1 Artevus Intellectual Property

The Service, including software, designs, branding (including "Blackwall VPN"), documentation, and related materials, are owned by Artevus or its licensors and protected by intellectual property laws.

7.2 Limited License

Nothing in these Terms grants you ownership of the Service. You receive only the limited license in Section 6.1.

7.3 Feedback

Suggestions, ideas, or feedback you provide (including through in-app feedback) may be used by Artevus without restriction or compensation to you.

7.4 Support and Feedback Content

If you submit support requests or feedback, you grant Artevus a license to use that content as needed to operate support, improve the Service, and respond to you.


8. Third-Party Services

The Service integrates with third parties including (without limitation) Apple, Google, RevenueCat, OneSignal, Resend, MongoDB hosting, DigitalOcean, and Cloudflare DNS. Your use of those services may be subject to their own terms and privacy policies. Artevus is not responsible for third-party services outside our control.

Purchases and subscription management through Apple or Google are also subject to the applicable store terms.


9. Privacy

Our collection and use of personal data is described in the Blackwall VPN Privacy Policy. By using the Service, you acknowledge that policy. Blackwall VPN is operated as a no-log VPN as defined there: we do not log browsing history, DNS queries, destination IPs, or traffic content.


10. Disclaimers and Limitation of Liability

10.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR UNINTERRUPTED OR ERROR-FREE OPERATION. WE DO NOT WARRANT THAT THE VPN WILL BYPASS ALL BLOCKS, GEO-RESTRICTIONS, OR NETWORK FILTERS, OR THAT ANY PARTICULAR SITE OR SERVICE WILL BE REACHABLE.

10.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTEVUS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF PROFITS, DATA, GOODWILL, OR SERVICE INTERRUPTION, ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE.

Artevus's total cumulative liability for any claim relating to these Terms or the Service shall not exceed the greater of: (a) the amount you paid to Artevus (via the app stores) for Blackwall VPN in the twelve (12) months preceding the claim, or (b) one hundred US dollars (USD $100).

Some jurisdictions do not allow certain limitations; in those cases, liability is limited to the maximum extent permitted by law.


11. Indemnification

You agree to defend, indemnify, and hold harmless Artevus and its officers, directors, employees, and agents from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of law or third-party rights; or (d) content or activity you transmit through the VPN.


12. Suspension and Termination

Artevus may suspend or terminate your access at any time, with or without notice, for breach of these Terms, abuse, legal risk, non-payment, or operational reasons.

You may stop using the Service and delete your account at any time as described in Section 3.5 and the Privacy Policy.

Upon termination, your license ends immediately. Provisions that by nature should survive (including intellectual property, disclaimers, indemnification, and limitations of liability) survive termination.


13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms shall be governed by applicable law without regard to conflict-of-law principles. You agree to comply with local laws applicable to your use of the Service, including export controls and VPN regulations where relevant.

13.2 Informal Resolution

Before formal proceedings, contact us at legal@artevus.com (or info@artevus.com) to attempt informal resolution.

13.3 Dispute Resolution

If informal resolution fails, disputes shall be submitted to binding arbitration in accordance with applicable arbitration rules, unless prohibited by law in your jurisdiction.

13.4 Class Action Waiver

Where permitted by law, you agree that dispute proceedings will be conducted only on an individual basis and not as a class, consolidated, or representative action.


14. Changes to Terms

We may modify these Terms at any time. We will post an updated version with a new "Last Updated" date and may notify you via the app or email for material changes. Continued use after the effective date constitutes acceptance. If you do not agree, stop using the Service and delete your account.


15. Miscellaneous

  • Entire agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and Artevus regarding Blackwall VPN.
  • Severability: If any provision is unenforceable, the remainder remains in effect.
  • Waiver: Failure to enforce a provision is not a waiver.
  • Assignment: You may not assign these Terms without our consent. Artevus may assign without restriction.
  • Force majeure: We are not liable for delays or failures beyond our reasonable control.
  • No legal advice: Nothing in the Service constitutes legal advice about the legality of VPN use in your location.
