MapStride Terms of Service

Welcome to MapStride. These Terms of Service ("Terms") are a legally binding agreement between you ("User", "you", "your") and Artevus Technologies (Private) Limited ("Artevus", "Company", "we", "us", "our").

These Terms apply to your use of the MapStride mobile application on iOS and Android, related websites, and associated services (collectively, the "Service" or "App").

By accessing or using MapStride, you confirm that:

  • You have read, understood, and agree to these Terms and our Privacy Policy

  • You are at least 13 years of age (or 16 in the EU/EEA where required by applicable law)

  • If you use the Service on behalf of an organization, you have authority to bind that organization

If you do not agree to these Terms, do not use the Service.

MapStride is a fitness tracking application that allows users to record and review walking, running, cycling, and related activity, view maps and workout history, set goals, optionally sync with health platforms, receive notifications, and share workout summaries.

MapStride is a fitness and wellness tool. It is not a medical device and does not provide medical advice, diagnosis, or treatment.

Certain features require an account. You may register using email and password, Google Sign-In, or Sign in with Apple.

When creating an account, you agree to:

  • Provide accurate and complete information

  • Keep your account information up to date

  • Maintain the confidentiality of your login credentials

  • Notify us promptly of any unauthorized use of your account

  • Accept responsibility for activity that occurs under your account

You may use certain features of MapStride without creating an account. Guest data is stored primarily on your device and may be limited. Creating an account enables cloud sync and additional features. Uninstalling the App or clearing app data may result in loss of guest data.

You may delete your account at any time through the App. Account deletion is subject to a grace period during which you may cancel the request. After deletion is finalized, your personal data is removed from our active systems as described in our Privacy Policy.

Please read this section carefully:

  • MapStride provides fitness tracking and informational metrics only.

  • The App is not intended to diagnose, treat, cure, or prevent any disease or medical condition.

  • Metrics such as distance, pace, calories, BMI, and similar estimates may be inaccurate and depend on device sensors, GPS conditions, and other factors.

  • Consult a qualified healthcare professional before beginning or changing an exercise program, especially if you have health concerns.

  • Exercise safely and remain aware of your surroundings. Do not use the App in situations that require your full attention, including while driving.

  • If you enable Health Sync, you are responsible for reviewing data shared with or imported from Apple Health or Google Health Connect.

You use MapStride and any fitness information it provides at your own risk.

MapStride may request access to location, motion and fitness data, health platforms, notifications, camera, and photos. These permissions are used to provide the features you choose to use. You may deny or revoke permissions in your device settings, but doing so may limit App functionality.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use MapStride for personal fitness tracking purposes.

You agree not to:

  • Copy, modify, reverse engineer, decompile, or create derivative works of the Service

  • Use the Service for any unlawful purpose

  • Introduce malware or attempt to disrupt or compromise the Service

  • Attempt unauthorized access to accounts, systems, or networks

  • Scrape, harvest, or collect data from the Service without permission

  • Impersonate any person or entity

  • Send spam or unsolicited communications through the Service

  • Resell, sublicense, or commercially exploit the Service without our prior written consent

  • Circumvent security or access controls

7. User Content

You may submit content through the Service, including profile information, workout titles, feedback, support requests, and photos ("User Content").

You retain ownership of your User Content. By submitting User Content, you grant Artevus a non-exclusive, worldwide, royalty-free license to use, store, process, and display that content solely as needed to operate and provide the Service.

You are responsible for your User Content and agree not to submit content that is unlawful, infringing, or otherwise violates these Terms or the rights of others.

If you share workout summaries or images with others, you are responsible for that sharing. We do not control how third parties handle content you choose to share.

The App, including its software, design, branding, and related materials, is owned by Artevus or its licensors and protected by applicable intellectual property laws. These Terms do not grant you any ownership rights in the Service.

Maps and related map data may be provided by third-party providers and remain subject to their terms and attribution requirements.

Any feedback or suggestions you provide about the Service may be used by Artevus without restriction or compensation to you.

We aim to keep the Service available and reliable, but we do not guarantee uninterrupted access, error-free operation, or complete accuracy of GPS, sensor, or fitness data. We may modify, suspend, or discontinue any part of the Service at any time.

Signed-in users may benefit from cloud sync. Guest users should understand that local data may be lost if the App is uninstalled or device storage is cleared.

If you enable notifications, we may send workout reminders, activity summaries, re-engagement messages, streak alerts, and service-related notices. You may manage or disable notifications in the App and in your device settings.

MapStride is free to use. We may offer optional one-time tip purchases processed through the Apple App Store or Google Play. Tips are voluntary, do not unlock essential features, and are generally non-refundable except where required by applicable law or platform policies. We do not currently offer subscriptions through MapStride.

The Service may integrate with or link to third-party services, including authentication providers, maps, analytics and crash reporting, notification services, payment processors, and health platforms. Your use of those services is subject to their own terms and privacy policies. Artevus is not responsible for third-party services.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, OR UNINTERRUPTED AVAILABILITY.

WE DO NOT WARRANT THAT FITNESS, GPS, OR HEALTH-RELATED METRICS WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARTEVUS AND ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR SERVICE INTERRUPTION, ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE SERVICE.

ARTEVUS’S TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO ARTEVUS IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS (USD $100).

Some jurisdictions do not allow certain limitations of liability. In those cases, our liability is limited to the fullest extent permitted by law.

You agree to defend, indemnify, and hold harmless Artevus and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Service, your User Content, your violation of these Terms, or your violation of any third-party rights.

You may stop using the Service at any time and may delete your account as described in these Terms and the Privacy Policy.

We may suspend or terminate your access to the Service at any time, with or without notice, if you violate these Terms or if we believe it is necessary to protect the Service, other users, or our legal rights.

Upon termination, your right to use the Service ends. Provisions that by their nature should survive termination will survive, including intellectual property, disclaimers, limitation of liability, indemnification, and governing law.

These Terms shall be governed by applicable law, without regard to conflict-of-law principles.

If a dispute arises, you agree to first contact us at info@artevus.com to attempt informal resolution. If informal resolution is unsuccessful, disputes shall be resolved through binding arbitration to the extent permitted by applicable law, on an individual basis and not as part of a class or representative action.

If you downloaded MapStride from the Apple App Store or Google Play Store:

  • These Terms are between you and Artevus, not Apple or Google

  • Apple and Google are not responsible for the App or its content

  • Apple and Google have no obligation to provide maintenance or support for the App

  • In the event of a failure to conform to any applicable warranty, you may notify Apple or Google for a refund of the purchase price, if any; otherwise, Apple and Google have no warranty obligation

  • Apple and Google are third-party beneficiaries of these Terms and may enforce them against you

Platform billing terms for tips are governed by Apple’s or Google’s applicable store terms.

We may update these Terms from time to time. When we make material changes, we will update the “Last Updated” date and may provide additional notice in the App or by other reasonable means. Your continued use of the Service after the updated Terms become effective constitutes acceptance, except where applicable law requires otherwise.

If you do not agree to the updated Terms, stop using the Service and delete your account.

  • These Terms, together with the Privacy Policy, constitute the entire agreement between you and Artevus regarding MapStride.

  • If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

  • Failure to enforce any provision is not a waiver of that provision.

  • You may not assign your rights under these Terms without our prior written consent. We may assign our rights without restriction.

  • We are not liable for delays or failures caused by events beyond our reasonable control.
